Terms of Service

1) What we do (and what we don’t)

The Service uses computer vision and machine-learning models to generate informational, non-official “pre-grade” predictions for trading cards based on images you upload. The Service is not an official grading service and does not replace professional evaluation. Results may be inaccurate, incomplete, biased, or unsuitable for your particular use case.

We are not affiliated with or endorsed by:

• The Pokémon Company, Nintendo, or GAME FREAK inc.
• Any other card grading companies or rights holders.

Trademarks: “Pokémon,” “Pokémon TCG,” “Nintendo,” “GAME FREAK,” and related names, logos, and characters are trademarks of their respective owners. Use on the Service is descriptive and nominative only to identify goods/services; no sponsorship or endorsement is claimed.

2) Eligibility

You must be at least 13 years old (or the age of digital consent in your region) to use the Service. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.

3) Your account

If you create an account, you must provide accurate information and keep your credentials secure. You are responsible for all activity under your account.

4) Your content & license to us

You may upload images and related data (collectively, “User Content”). You retain ownership of your User Content.

You grant us a worldwide, non-exclusive, royalty-free license to host, process, display, transmit, reproduce, and create derivative works from your User Content solely to operate, maintain, improve, and provide the Service (including model inference, quality assurance, abuse detection, and caching). If you opt-in, you additionally grant a license to use your User Content for model improvement and research; you may revoke future use at any time via settings or by contacting us.

You represent and warrant that:

• You own the User Content or have all rights needed to grant the above licenses;
• Your uploads do not infringe third-party rights (including copyrights, trademarks, or rights of publicity);
• Your uploads do not contain unlawful content or personal data of others without their consent.

We may remove or disable User Content we reasonably believe violates these Terms or law.

5) Prohibited uses

• Use the Service to infringe intellectual property or publicity/privacy rights;
• Attempt to reverse engineer, scrape, mine, or circumvent rate limits or security;
• Upload malware, illegal, or harmful content;
• Misrepresent Service outputs as official or as coming from The Pokémon Company, Nintendo, GAME FREAK, or any other rights holder;
• Use outputs for deceptive, fraudulent, or unlawful purposes, including claims implying official certification.

We may throttle or suspend access for suspected abuse.

6) Ads, sponsorships, and third-party services

The Service may display advertising, sponsored content, affiliate links, and analytics provided by third parties. We do not control or endorse third-party content and are not responsible for its accuracy, legality, or safety. Your interactions with advertisers are solely between you and them and may be governed by separate terms and privacy notices. See our Privacy Policy for details on ad tech and tracking.

7) Payments & subscriptions (if offered)

• Prices and features are described at checkout; taxes may apply.
• Unless stated otherwise, plans auto-renew until you cancel.
• Refunds are at our discretion unless required by law.
• We may change pricing or features on notice; changes take effect on your next billing cycle.

8) No professional grading; important disclaimers

• Informational only. Outputs are probabilistic predictions and not professional advice or official grading.
• No guarantees. Accuracy depends on image quality, lighting, angles, card variations, training data, and other factors.
• Use at your own risk. Decisions you make (e.g., whether to submit a card, list for sale, set price, or insure) are your responsibility.

We expressly disclaim any affiliation, endorsement, sponsorship, or approval by The Pokémon Company, Nintendo, GAME FREAK, or any other grading or IP owner. Do not use our names or theirs in a way that suggests endorsement.

9) Intellectual property

Except for your User Content, the Service (including software, models, interfaces, and branding) is owned by us or our licensors and protected by law. You may not copy, modify, distribute, create derivative works, or use our IP except as permitted in these Terms.

10) Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and share information (including for ads/analytics). You agree to that policy.

11) Service changes & availability

We may modify, suspend, or discontinue the Service (or any part) at any time. We are not liable for downtime, latency, data loss, or feature changes. Features may rely on third-party infrastructure (e.g., hosting, model providers) that we do not control.

12) Warranties & liability

THE SERVICE AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ACCURACY, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE.

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, goodwill, data, or business, arising out of or relating to your use of the Service, even if advised of the possibility of such damages.

Our total liability for any claim arising out of or relating to the Service will not exceed the greater of (a) USD $100 or (b) the amount you paid us for the Service in the 3 months preceding the claim. Some jurisdictions do not allow certain limitations; in those cases, the limitations apply to the fullest extent allowed.

13) Indemnification

You agree to defend, indemnify, and hold harmless Company and its officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your User Content; (b) your use of the Service; (c) your breach of these Terms; or (d) your violation of any law or third-party right (including IP or publicity rights).

14) API & rate limits (if applicable)

We may offer an API subject to separate documentation and usage limits. You must keep credentials secure, respect rate limits, and comply with all restrictions in our docs. We may suspend or revoke API access at any time.

15) Termination

You may stop using the Service at any time. We may suspend or terminate access immediately if we believe you violated these Terms or law, or for operational/security reasons. Sections that by their nature should survive termination (e.g., IP, disclaimers, limitations, indemnity, dispute resolution) will survive.

16) Governing law

These Terms are governed by the laws of Delaware, without regard to conflict of law principles.

18) Changes to these Terms

We may update these Terms from time to time. The “Effective date” will show when changes take effect. If changes are material, we will provide reasonable notice (e.g., by posting or email). Your continued use after the effective date constitutes acceptance.
